1. Definitions
StoreToApp: Refers to the brand and services provided by StoreToApp [under Acybus Technologies LLP], including but not limited to mobile app creation, customization, and associated services.
Client: Refers to any individual or entity that subscribes to or utilizes StoreToApp’s services.
Services: Refers to all services provided by StoreToApp, including mobile app creation, customization, and ongoing support.
2. Acceptance of Terms
By using StoreToApp, you confirm that you have read, understood, and agreed to these terms. If you do not agree with any part of these terms, you must not use our services.
3. Service Description
StoreToApp provides a platform for Shopify sellers to create customized mobile applications for their stores. The service includes app development, design customization, and technical support.
4. Subscriptions and Payments
Subscription Plans: StoreToApp offers subscription plans as detailed on our pricing page. The subscription fee is billed monthly.
Payment: Clients must provide accurate and up-to-date payment information. Payments are processed securely, and StoreToApp is not liable for any issues arising from payment processing by third parties.
Cancellation: Clients may cancel their subscription at any time, but no refunds will be provided for the unused portion of the subscription term.
5. Client Responsibilities
Content Provision: Clients are responsible for providing all necessary content for their mobile apps, including product images, descriptions, and other relevant data.
Compliance: Clients must ensure that their content and app usage comply with applicable laws and regulations, including but not limited to intellectual property rights, privacy laws, and consumer protection laws.
6. Intellectual Property
Ownership: StoreToApp retains all rights, title, and interest in the software and services provided. Clients receive a non-exclusive, non-transferable license to use the mobile app created for their store.
Client Content: Clients retain ownership of all content provided to StoreToApp for inclusion in their mobile app.
7. Confidentiality
StoreToApp will treat all client information as confidential and will not disclose it to third parties without the client’s consent, except as required by law.
8. Limitation of Liability
StoreToApp is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our services. Our liability is limited to the amount paid by the client for the services in the preceding three months.
9. Termination
StoreToApp reserves the right to suspend or terminate a client’s access to the services at any time, with or without notice, for breach of these terms or any other reason.
10. Changes to Terms
StoreToApp may update these terms from time to time. Clients will be notified of any significant changes, and continued use of the services after such changes constitutes acceptance of the new terms.
11. Governing Law
These terms are governed by and construed in accordance with the laws of Jaipur, Rajasthan, India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan, India.
